If US guarantees for Ukraine do not include funding, it will have to be fought for every year – lawyer

The main aspect of the US guarantees for Ukraine will not be their text, but the availability of annual funding, otherwise we will have to fight for support. About this, for text by LIGA.net, said Stephen Moore, a lawyer and former congressional consultant.

According to him, there are two levels of international agreements in the United States: a treaty, which has the force of law, and an executive agreement, which is based only on the political goodwill of the American president.

Moore emphasized that security guarantees without ratifications in the Senate is "pure politics." He added that even after this procedure, the main thing will not be the text of the document, but the annual funding.

"Otherwise, Ukraine will again find itself in a situation where it will have to fight for aid every year," the expert explained.

The lawyer calls such documents "assurances," or promises without legal obligation. In his opinion, in such cases, we are talking about Budapest 2, but in a new geopolitical wrapper.

Moore noted that the issue is not one of legal technique, but of philosophy: the United States is ready to guarantee only what does not tie its own hands.
